Policy & Terms of Service

Overview

Branded By Ki (“BBK”) provides creative design and branding services, including but not limited to graphic design, brand strategy, content creation, and consultation services. By engaging BBK, clients agree to the terms outlined in this policy.

1. Services & Deliverables

All service deliverables are outlined in the service’s description. Changes or additions to the project scope may incur additional fees. Delivery timelines are provided in the service’s description, and BBK will communicate any changes promptly. Clients are responsible for providing timely feedback, content, and materials necessary to complete the project.

2. Payment Terms

Payments must be made as outlined in the service’s description (e.g., deposit, full payment, milestone payments). Accepted payment methods include [Cash App, Zelle, PayPal, etc.]. Late payments may result in project delays or suspension of services. Refunds are at BBK’s discretion unless otherwise stated in the service description.

3. Promotion & Portfolio Usage

By engaging and hiring BBK, clients grant permission for BBK to use the final designs, content, and services provided for promotional purposes, including but not limited to:

  • Social media posts
  • Website portfolio
  • Marketing materials
  • Case studies or presentations

BBK will maintain client confidentiality for any sensitive materials upon request. Any restrictions on promotion must be communicated before project commencement.

4. Client Responsibilities

Clients are expected to provide accurate information and materials in a timely manner, respond to BBK’s requests for feedback within 1–3 business days, and communicate clearly regarding expectations, goals, and any concerns. Maintaining open and timely communication ensures that projects run smoothly and that BBK can deliver work that aligns with the client’s vision.

5. Revisions & Approvals

Projects include three rounds of revisions; additional revisions may incur extra fees. Final approval is required before project delivery or publication. Clients must review deliverables promptly, as failure to respond within five business days may be considered approval or project may be dismissed. Once a project is finalized, all files will be deleted approximately one week after delivery. BBK will not be able to make edits or adjustments to the project after this period, so it is the client’s responsibility to review and confirm all deliverables before the finalization date.

7. Conflict Resolution

BBK prioritizes open communication and resolving any questions or concerns quickly and professionally. If an issue arises, the client and BBK will first discuss it directly via email, call, or message to reach a solution. Any agreed-upon changes or resolutions will be documented in writing for clarity. If the issue cannot be resolved through discussion, a mutually agreed-upon third party may be consulted. BBK reserves the right to make final decisions regarding project direction, scope, and intellectual property, as long as these decisions align with the service description and this policy. By engaging BBK, clients acknowledge that all terms are outlined in the service description and policy, which serve as the binding agreement.

8. Intellectual Property & Ownership

Clients retain ownership of the final deliverables once full payment has been received. BBK retains the right to use designs and projects for promotional purposes, portfolio showcases, and marketing, as outlined in Section 4. BBK is not responsible for any third-party claims arising from client-provided materials that infringe on copyrights, trademarks, or other intellectual property rights. Clients are responsible for ensuring that any materials they provide do not violate the rights of others.

9. Termination

Either party may terminate a project with written notice. If a client chooses to terminate before any work has begun, they are eligible for a full refund. If a first draft or any work has already been delivered, BBK will retain 50% of the project fee to compensate for time and effort. BBK reserves the right to terminate a project if the client violates this policy, including failure to provide necessary materials, unresponsive communication, or other breaches. In such cases, BBK will retain 100% of the payment already made. Termination does not revoke BBK’s rights to use completed work for promotional purposes, unless otherwise agreed.

10. Liability & Disclaimer

BBK is not liable for any indirect, incidental, or consequential damages arising from the services provided. While BBK strives for accuracy, professionalism, and excellence in all projects, specific results or outcomes for client campaigns or projects cannot be guaranteed. Clients acknowledge that creative work involves interpretation and execution, and BBK’s role is to provide expert guidance and deliverables in line with the agreed service description and policy.

11. Amendments

BBK reserves the right to update or amend this policy at any time. Clients will be notified of any material changes prior to engaging in future services, and continued use of BBK’s services constitutes acceptance of the updated policy.
